These Terms and Conditions ("Terms") govern your access to and use of the website sybago.ai, the services we provide (the "Services"), and the SMS messaging program operated by Sybago LLC ("Sybago," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Acceptance of Terms
By accessing the Services, submitting a form on our site, opting in to SMS messages, or engaging our paid services, you agree to these Terms and our Privacy Policy. These Terms form a binding agreement between you and Sybago LLC.
2. Description of Services
Sybago LLC provides AI-powered business automation services for service-based businesses, including but not limited to missed-call text-back systems, automated review requests, database reactivation campaigns, custom websites, and related workflow automation. Specific deliverables, pricing, and timelines are set out in individual service agreements.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that any information you provide is accurate and truthful.
4. Your Account and Your Information
If you engage our paid Services, you may be required to provide account information. You are responsible for maintaining the confidentiality of any credentials and for all activity under your account. You agree to notify us promptly of any unauthorized use.
You represent and warrant that any telephone number you submit to us is associated with you (or that you have authorization from the account holder) and that you have the right to receive SMS messages at that number.
5. SMS Messaging Disclosure
Program name: Sybago SMS Program.
Operator: Sybago LLC.
Types of messages
By opting in, you consent to receive SMS text messages from Sybago LLC in one or more of the following categories, based on the consent you select:
- Customer care: account issues, service outages, support responses, appointment confirmations, and other non-promotional operational messages.
- Marketing: new offers, promotions, announcements, and other promotional content.
- Two-factor authentication (2FA) and security notifications, where applicable to your account.
How you opt in
You can opt in to the Sybago SMS Program by providing your telephone number and checking the applicable consent box(es) on our Contact Us form. You may select customer care, marketing, or both. Consent to receive SMS messages is not a condition of any purchase.
Message frequency
Message frequency may vary. The number of messages you receive depends on the consent categories you selected and your activity with Sybago.
Message and data rates
Message and data rates may apply. Standard messaging rates charged by your mobile carrier will apply to all SMS messages you receive. Consult your mobile carrier for details about your plan.
How to opt out
You can cancel the SMS Program at any time by texting STOP to any message you receive from Sybago. After you send STOP, we will send you a confirmation text and you will not receive further SMS messages from us, except as required to confirm the cancellation. If you want to rejoin the program, sign up again as you did the first time.

If you need assistance with the SMS Program, reply HELP to any message, or email support@sybago.ai. You will receive a response with instructions for contacting us.
Supported carriers
The SMS Program is available through major U.S. carriers. Carriers are not liable for delayed or undelivered messages. Message delivery depends on network availability and other factors outside of our control.
Privacy
Your use of the SMS Program is subject to our Privacy Policy. No mobile information, including SMS opt-in consent and telephone numbers associated with SMS consent, will be shared with third parties or affiliates for marketing or promotional purposes. This exclusion does not apply to service providers (such as our SMS delivery platform) who process information on our behalf solely to deliver the messages you have opted in to receive.
6. Intellectual Property
The Services, including all content, text, graphics, logos, software, and other materials, are owned by or licensed to Sybago LLC and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works based on the Services or any portion of them without our prior written consent.
7. Prohibited Uses
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
- Submit false, misleading, or inaccurate information, including telephone numbers you do not have authorization to use.
- Interfere with or disrupt the Services, our servers, or networks.
- Attempt to gain unauthorized access to any part of the Services, other accounts, or connected systems.
- Use the Services to send unsolicited commercial messages, spam, or malicious content.
- Reverse engineer, decompile, or attempt to extract the source code of any Services software.
- Use automated means (bots, scrapers) to access or collect data from the Services without our express permission.
8. Third-Party Services
The Services may integrate with or link to third-party platforms (such as customer relationship management systems, payment processors, SMS delivery platforms, and booking tools). We are not responsible for the availability, content, or practices of third-party services, and your use of them is governed by their own terms.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
WE DO NOT GUARANTEE ANY SPECIFIC BUSINESS OUTCOMES, INCLUDING BUT NOT LIMITED TO THE NUMBER OF LEADS, APPOINTMENTS, REVIEWS, OR REVENUE YOU MAY GENERATE AS A RESULT OF USING THE SERVICES. ACTUAL RESULTS DEPEND ON YOUR BUSINESS, YOUR EFFORTS, AND FACTORS OUTSIDE OF OUR CONTROL.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SYBAGO LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to indemnify, defend, and hold harmless Sybago LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, Sybago, or third parties. You may stop using the Services at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
13. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
14. Dispute Resolution
Before filing a claim, you agree to first contact us at legal@sybago.ai to attempt to resolve the dispute informally. If the dispute is not resolved within thirty (30) days, either party may proceed with formal legal action in accordance with Section 13.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated to you through our website or by other reasonable means. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
16. Miscellaneous
- Entire agreement: these Terms, along with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Sybago with respect to the Services.
- Severability: if any provision is held invalid or unenforceable, the remaining provisions will continue in full force.
- No waiver: our failure to enforce any provision is not a waiver of that provision or any other rights.
- Assignment: you may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.
